Let’s be honest… AI is remarkable. It can draft a business plan, explain the French Revolution, write a cover letter, and even debate philosophy with you at 2am. We use it ourselves. But lately, we’ve been seeing something that genuinely concerns us: people turning to ChatGPT, Claude, and other AI platforms to handle their personal injury claims. We feel professionally obligated (with love) to tell you why that’s a very bad idea.
First, Let’s Give AI Its Flowers
AI platforms can help you understand general legal concepts, explain what certain terms mean, and help you organize your thoughts before a consultation. Think of it as a very smart, very well-read friend who went to every law school but never actually graduated or practiced law. Great for explaining things. Not so great when it’s time to fight.
What AI Cannot Do
It cannot negotiate with insurance adjusters. Adjusters are professionals trained to minimize what they pay you. They know every tactic i.e., the lowball offer, the delay-and-wear-you-down strategy. Pasting an AI-generated demand letter into an email is not negotiation.
It cannot evaluate the true value of your claim. Calculating damages requires experience, comparable case data, and knowledge of what juries in your specific jurisdiction have awarded. An AI gives you a framework. A seasoned attorney gives you a number grounded in reality.
It can confidently give you wrong information. AI models can “hallucinate”. Meaning they produce information that sounds authoritative and is completely inaccurate. Outdated statutes. Misquoted or entirely made-up case law. Getting any of those wrong doesn’t just weaken your case, it can end it.
AI cannot represent you in court. Full stop. If your case goes to litigation, you will face a defense attorney whose entire job is to eliminate your recovery. No AI will file your complaint, argue motions, or stand in front of a jury.
The Statute of Limitations Doesn’t Care About Your Prompt History
In Nevada and California, you generally have two years from the date of your injury to file a personal injury lawsuit. Miss that window while iterating on your AI-generated demand letter, and your claim is gone permanently. An attorney tracks these deadlines from day one because their license depends on it.
The “I’ll Save Money” Math Doesn’t Add Up
